Welcome to Point Loma Estate Planning APC

Today we’re talking with Ted Cook, a conservatorship attorney practicing in sunny San Diego. He specializes in helping families navigate the complex legal landscape of conservatorships.

So Ted, what exactly is a Conservatorship and when might someone need one?

Ted explains: “A conservatorship is a legal arrangement where a court appoints someone to manage the personal or financial affairs of an adult who can’t do so themselves. Think of it like guardianship for adults. It’s often needed when someone has experienced a decline in their cognitive abilities due to dementia, stroke, or severe mental illness.”

He continues: “Sometimes it’s a matter of protecting someone from financial exploitation. Other times, it might be necessary to ensure an individual receives proper medical care and support.”

Let’s dive into the Conservatorship process. Could you walk us through one of those key steps?

Ted chooses to discuss “Establishing a Conservatorship”:

“This is where we lay the groundwork for everything else. It all begins with filing a petition in court, outlining why a conservatorship is necessary. We have to be thorough and provide concrete evidence that the individual can’t handle their own affairs safely.”

He adds:

  • “Next comes notifying all interested parties – family members, the proposed conservatee themselves if possible. Transparency is crucial.”
  • “Then we have a court investigator who will independently assess the situation, looking into the individual’s living conditions, health status, and any support systems they might have.”

Ted emphasizes: “Finally, a medical or psychological evaluation is conducted to determine the individual’s capacity. The judge ultimately reviews all this information to decide whether a conservatorship is warranted.”

Have you ever encountered any hiccups during this initial stage?

Ted reflects for a moment: “I recall one case where family members were strongly opposed to the conservatorship, believing it was unnecessary. It took some extra effort to bridge that divide and ensure everyone understood the individual’s needs.”

He shares another instance: “In another case, locating the proposed conservatee proved challenging as they had moved frequently. We had to enlist the help of social services to track them down. These situations highlight why it’s important to have a skilled and experienced attorney on your side.”

More Facts About A Conservatorship:

A conservatorship is a court-ordered legal process where a judge appoints a conservator (a person or organization) to manage the affairs of an adult (the conservatee) who is unable to care for themselves or their finances due to incapacity.

Definition: A conservatorship is a court proceeding where a judge appoints a conservator to manage the personal and/or financial affairs of an adult who is unable to do so themselves.

Purpose: The conservatorship aims to protect the conservatee’s well-being by ensuring their basic needs are met and their finances are managed appropriately.

What Is a Conservatorship?
A conservatorship is a court-ordered legal relationship in which a judge appoints a responsible individual or organization (the conservator) to manage the financial affairs, and sometimes the personal care, of a person who is unable to manage these matters on their own. This may be due to advanced age, cognitive impairment, serious illness, or disability. Conservatorships typically apply to adults, though similar protections for minors may fall under guardianships, depending on the jurisdiction.

There are generally two types of conservatorships:

Conservatorship of the estate, where the conservator handles financial matters such as paying bills, managing investments, and protecting assets.

Conservatorship of the person, where the conservator makes decisions about personal needs, including housing, healthcare, and daily living.

In some instances, a conservator may be appointed to manage both aspects. While conservators and guardians can have overlapping responsibilities, the terminology and roles can vary by state law.
