Testamentary trusts offer several advantages. They can provide structure for managing assets for minor children or beneficiaries who may need assistance handling finances responsibly.

Moreover, they allow you to dictate specific terms for how and when your beneficiaries receive their inheritance.

Real-World Example

For instance, let’s say you want to ensure your child’s college education is funded but don’t trust them to manage a large sum of money at 18. A testamentary trust could specify that funds are released for educational expenses until the child reaches a certain age, say 25, when they may have developed better financial judgment.

While testamentary trusts are valuable tools, it’s important to remember they involve probate. This process can be time-consuming and potentially costly.
