Hello everyone, and welcome back to our series on protecting our most vulnerable citizens. Today we have the pleasure of speaking with Ted Cook, a dedicated elder protection attorney based right here in sunny San Diego. Ted, thanks for taking the time to chat with us!
How did you get started in Elder Protection Law?
Well, it wasn’t necessarily a straight line. I always knew I wanted to practice law, but early on, I focused on corporate work. However, after seeing firsthand how easily seniors could be taken advantage of, both financially and emotionally, I felt a strong pull towards elder protection. It’s incredibly rewarding to use my legal skills to ensure our elders are treated with dignity and respect.
What are the Key Steps Involved in Protecting Seniors from Abuse?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Can You Elaborate on the ‘Protective Actions’ Step in Elder Protection?
Absolutely. This step is often crucial and can involve a variety of legal remedies depending on the specific situation. If there’s an immediate threat, we might file for a restraining order to prevent further harm. We also frequently work with Adult Protective Services (APS) to report suspected abuse and ensure the elder’s safety.
In cases involving financial exploitation, we can take steps to freeze bank accounts or challenge questionable power of attorney arrangements.
“Ted helped me navigate a really difficult situation when my mother was being financially exploited by a caregiver. He was compassionate, thorough, and ultimately got her finances back on track.” – Mary S., La Jolla
“For example,” Ted recalls, “I once represented a woman whose son was systematically draining her bank account. We were able to freeze the funds and work with law enforcement to bring criminal charges against him.”
“Ted’s knowledge of elder law is impressive. He explained everything clearly and made sure I understood all my options.” – John D., Point Loma
Do You Have Any Tips for Family Members Concerned About an Elderly Loved One?
“I was so relieved to find Ted Cook. He helped me understand my rights as a granddaughter and took decisive action to protect my grandmother from further abuse.” – Sarah K., Carlsbad
Definitely. The most important thing is to trust your instincts. If something seems off, don’t ignore it. Talk to your loved one, pay attention to any changes in their behavior or finances, and don’t be afraid to seek professional help. Early intervention can make all the difference.
Remember, seniors are often vulnerable to exploitation due to factors like declining cognitive abilities or isolation. Staying vigilant and informed is key to protecting them.
