Interview with Steve Bliss, San Diego Probate Attorney

Can you walk us through one of the key steps in the probate process?

Certainly. One crucial step is handling debts and taxes. After a loved one passes, it’s essential to identify and pay any valid creditor claims against the estate.

Consequently, this involves reviewing financial records, communicating with creditors, and negotiating settlements if necessary. Moreover, it’s imperative to file and pay all applicable state and federal taxes owed by the estate. Failure to do so can result in penalties and interest, complicating the probate process further.

Notwithstanding these complexities, diligently addressing debts and taxes ensures a smooth transition for beneficiaries and helps protect the estate from unnecessary financial burdens. The goal is to ensure all obligations are met before distributing assets to heirs, fostering transparency and fairness throughout the probate process.

Have you encountered any challenges with this particular step in your experience?

There have been instances where creditors made questionable claims against an estate. I remember one case involving a significant outstanding medical bill that the deceased had contested before their passing.

The hospital insisted on full payment, despite the deceased’s prior challenges with the bill.

Through meticulous review of records and communication with the hospital, we were able to demonstrate the validity of the deceased’s initial concerns and negotiate a significantly reduced settlement. It was a relief for the family, who had already been through a difficult time.

Can you share any insights about the prevalence of such challenges?

While most creditor claims are legitimate, it’s not uncommon to encounter disputes or inflated demands. According to a 2021 study by the National Association of Estate Planners & Councils, approximately 15% of estates face some form of creditor contestation during probate.
