Good morning, San Diego and welcome back to our legal spotlight segment. Today, we’re joined by Steve Bliss, a renowned probate attorney here in San Diego. Steve, thanks for being with us.
Understanding Trusts: A Vital Tool for Estate Planning
Steve, many people are unfamiliar with trusts and their role in estate planning. Could you shed some light on the different types of trusts available and why they might be beneficial?
Certainly. Trusts are powerful legal instruments that can help individuals manage and distribute their assets during their lifetime and after their passing. One common type is the Revocable Living Trust, which allows the creator, known as the grantor, to maintain control over the assets placed within the trust. They can modify or even dissolve the trust while they’re alive.
Conversely, an Irrevocable Trust offers greater asset protection but typically cannot be altered once established. It’s a good option for those looking to minimize estate taxes or protect assets from potential creditors.
The Advantages of a Revocable Living Trust
Steve, you mentioned the Revocable Living Trust. Can you elaborate on its benefits and how it can help individuals avoid probate?
Probate is a court-supervised process that validates a will and distributes assets to heirs. It can be time-consuming, expensive, and public. A Revocable Living Trust bypasses probate altogether. Consequently, the assets within the trust transfer directly to designated beneficiaries upon the grantor’s death, saving time and legal fees.
Moreover, a Revocable Living Trust offers privacy as it doesn’t become part of public record like a will does. This is important for many individuals who prefer to keep their financial affairs confidential.
Ordinarily, I advise my clients to consider a Revocable Living Trust if they want to streamline the asset distribution process and maintain control over their assets during their lifetime.
Real-World Challenges
Have you encountered any specific challenges when setting up or administering Revocable Living Trusts?
One situation I recall involved an elderly couple who had neglected to update their trust for several years. Their children had grown, gotten married, and had children of their own. When the husband passed away, the trust documents no longer accurately reflected their wishes regarding asset distribution. It required some legal maneuvering to amend the trust and ensure that all beneficiaries were treated fairly.
That experience highlighted the importance of regularly reviewing and updating trust documents to reflect life changes. It’s not a “set it and forget it” solution.
Peace of Mind for Families
It’s clear you are passionate about helping families navigate these complex legal matters. What feedback have you received from clients who have utilized Revocable Living Trusts?
“Steve Bliss was a true lifesaver when it came to setting up our trust. He explained everything in plain English and made the process so much easier than we expected,” shared one satisfied client.
Another client remarked, “Knowing that our assets will be handled according to our wishes, and that our children won’t have to deal with a lengthy probate process, gives us tremendous peace of mind.”
