It ensures debts are paid and property is transferred according to the individual’s wishes, as outlined in their will. Now, it’s not always necessary, for instance if someone has meticulously set up a trust.

Let’s delve into one of the key steps within probate: filing the petition. Can you walk us through that process?

Steve Bliss: Certainly. Filing a petition for probate is a fundamental step, initiating the entire legal process. Ordinarily, this involves submitting Form DE-111 to the county court where the deceased resided. Moreover, you’ll request to be appointed as the executor or administrator of the estate, assuming that role allows you to manage the distribution of assets.

If a will exists, it must be submitted along with the petition. The court then reviews the petition and, if all is in order, grants Letters Testamentary or Administration. This documentation officially authorizes you to act on behalf of the deceased’s estate.
