Absolutely! This step is crucial because it ensures that guardianship is truly necessary. The court appoints an investigator, often called a guardian ad litem, who acts as an independent voice for the proposed ward (the person needing guardianship).
This investigator dives deep into the situation: they interview the individual, their family members, and caregivers. They may even observe the living environment to get a sense of daily life. A medical or psychological evaluation is also often conducted to assess decision-making capacity.
The investigator then compiles all this information into a detailed report for the court. This helps the judge make an informed decision about whether guardianship is truly in the best interests of the individual.
