Can You Walk Us Through the Process of Establishing Guardianship?

Certainly! The guardianship process can seem daunting, but it’s designed to be thorough and protective.

Here’s a general overview: First, we determine if guardianship is actually necessary. This involves assessing whether someone is truly unable to make sound decisions for themselves regarding their personal care or finances.
We then consider if less restrictive options like a power of attorney might suffice. If guardianship is deemed necessary, we file a petition with the court outlining why it’s needed and who would be suitable as guardian.

Next, interested parties are notified, including family members and any relevant agencies. The court appoints an investigator to assess the situation, interview the individual in question, and gather information from those close to them.

Finally, a court hearing is held where all sides can present their case. If guardianship is approved, the appointed guardian takes an oath of office and receives official letters granting them authority.

It ensures that all angles are considered and that the individual’s best interests truly guide the decision. Imagine this scenario:

• A senior citizen, let’s call her Mrs. Johnson, has begun exhibiting signs of memory loss and confusion. Her adult children are concerned but unsure how to proceed. They contact me, and we determine that guardianship might be necessary.

We file a petition with the court, outlining Mrs. Johnson’s situation and proposing one of her daughters as guardian. The court appoints an investigator who meets with Mrs. Johnson at her home.
They observe her daily routine, interview her daughter about any recent changes in behavior, and speak to Mrs. Johnson’s doctor to get a medical assessment.

Based on the investigator’s findings and all other documentation presented, the court then makes a decision regarding guardianship.

Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
